We are committed to delivering measurable value through our social media advertising campaigns, pay-per-click marketing, and consumer inquiry facilitation services. This Refund Policy sets forth the terms under which refunds or service credits may be requested and issued, and reflects our commitment to fairness, transparency, and regulatory compliance — including adherence to A2P 10DLC standards governing our business text messaging practices.

Please read this policy carefully before enrolling in any Terra Nexus service plan. By completing your enrollment and payment, you acknowledge that you have read, understood, and agreed to the terms described below.

Scope of This Policy

This Refund Policy applies to all one-time service plan payments made to Terra Nexus for access to our digital marketing programs, consumer inquiry facilitation services, exclusive agent territory assignments, and related support services (collectively, “Services”). It applies to all agent partners enrolled through theterranexus.com or any affiliated Terra Nexus platform.

This policy does not apply to any third-party costs you may incur independently, such as advertising spend managed outside Terra Nexus systems, broker fees, or MLS costs.

One-Time Service Plan Fee

Terra Nexus charges a one-time service plan fee at the time of enrollment, corresponding to the plan tier you select. This fee funds the following:

  • Account setup, onboarding, and territory reservation

  • Design, launch, and management of your dedicated social media and/or PPC advertising campaigns

  • Consumer inquiry review, verification, and facilitation

  • Access to the Terra Nexus partner dashboard and dedicated success manager

  • 24/7 customer support throughout your active service period

Important: Terra Nexus’s fees cover marketing services and operational costs, not the purchase of a guaranteed outcome. Digital marketing results are inherently subject to market conditions, consumer behavior, and campaign performance. Our refund eligibility criteria reflect this reality while still protecting your investment.

Refund Eligibility

Refunds are available under a limited set of circumstances as described below. Outside of these conditions, all fees are non-refundable due to the immediate operational costs incurred upon enrollment.

a — Eligible Condition: No Consumer Inquiries Delivered Within 60 Days

If Terra Nexus fails to facilitate any consumer inquiry to you within sixty (60) calendar days of your enrollment date — despite your campaigns being fully active and your account being in good standing — you may submit a written refund request. This is the primary and sole basis for a monetary refund.

This condition does not apply if:

  • You requested your campaign to be paused or delayed after enrollment

  • Your account was placed on hold at your request

  • You failed to complete onboarding steps required to activate your campaign

  • Your market had targeting constraints disclosed to you at the time of enrollment

b — Service Credits for Unqualified Inquiries

Terra Nexus does not issue monetary refunds based on the outcome of individual consumer inquiries. However, if a consumer inquiry delivered to you does not meet the following baseline quality criteria, you are entitled to a complimentary replacement inquiry:

  • The contact information provided (phone and/or email) is demonstrably invalid or non-functional

  • The consumer explicitly states they did not inquire about real estate services and did not opt in

  • The consumer is located entirely outside your agreed-upon service territory

  • The inquiry was delivered due to a verified technical or data error on the part of Terra Nexus

Replacement inquiries — not monetary refunds — are the standard remedy for individual inquiry quality concerns. Replacements are subject to review and approval by our team.

Consumer inquiries are delivered via email notification and/or to your partner dashboard within your agreed campaign cycle.

Review Window

You have 48 hours from delivery to review the inquiry and submit a replacement request if it does not meet the quality criteria in Section 3b.

Replacement Request

Submit replacement requests to info@theterranexus.com with your account information and the specific reason for the request.

Deemed Acceptance

Inquiries not challenged within 48 hours are considered accepted. Accepted inquiries are not eligible for replacement or refund.

Replacement Fulfillment

Approved replacements are typically fulfilled within 5–10 business days, subject to campaign activity and market availability.

A2P 10DLC Compliance & SMS Communication Policy

A2P 10DLC Compliance Notice

Terra Nexus is registered under the A2P 10DLC (Application-to-Person 10-Digit Long Code) framework, which governs how businesses send text messages to consumers in the United States. All SMS communications sent by Terra Nexus comply with The Campaign Registry (TCR) requirements and applicable carrier guidelines.

The following provisions apply specifically to our SMS communications and are incorporated into this Refund Policy to ensure full transparency with our agent partners and any consumers who interact with our marketing campaigns:

a — Consumer SMS Consent

Terra Nexus sends text messages to consumers only after receiving explicit, documented opt-in consent. Consumers who engage with our social media advertisements and landing pages voluntarily provide their contact information and consent to follow-up communication. We do not send unsolicited text messages to purchased lists or cold contacts. All SMS opt-in records are retained in compliance with applicable regulations.

b — Agent Partner SMS Communications

When you enroll as a Terra Nexus agent partner and provide your mobile phone number, you consent to receive SMS messages from Terra Nexus related to your account, campaign activity, consumer inquiry notifications, and service updates. These messages are sent under our registered A2P 10DLC campaigns.

  • Message frequency varies based on your account activity and campaign cycle.

  • Message and data rates may apply. Please consult your wireless carrier for details.

  • To opt out of SMS at any time, reply STOP to any message. We will send one final confirmation and cease sending SMS to your number.

  • To request assistance, reply HELP to any Terra Nexus SMS or email info@theterranexus.com.

  • Opting out of SMS does not cancel your service agreement or affect your refund eligibility.

c — No Refunds for SMS Opt-Out

Choosing to opt out of SMS notifications does not constitute a service disruption or entitle you to a refund. Consumer inquiry notifications and account updates will continue to be delivered via your registered email address and partner dashboard.

d — SMS-Related Compliance Concerns

If you believe you received an SMS message from Terra Nexus in error, or that a message was sent without proper consent, please contact us immediately at info@theterranexus.com or +1 215-201-4884. We take compliance seriously and will investigate all reports promptly.

Non-Refundable Conditions

The following circumstances do not qualify for a monetary refund under any condition:

  • Consumer inquiries have been delivered within the 60-day window, regardless of whether they converted into a transaction

  • You accepted or failed to challenge an inquiry within the 48-hour review window

  • Request is based on lead quality, conversion rate, response rate, or subjective dissatisfaction with outcome

  • Delay in inquiry delivery was caused by incomplete onboarding, a campaign hold you requested, or a targeting constraint disclosed at enrollment

  • Fees paid for optional add-on services or upgrades beyond your base plan

  • Personal circumstances including change of employment, license status, market exit, or business decision to discontinue real estate practice

  • Market fluctuations, interest rate changes, or regional real estate conditions affecting consumer demand

Once consumer inquiries have been delivered and your campaign has been actively running, the operational costs incurred by Terra Nexus are non-recoverable, which is reflected in this policy structure.

How to Submit a Refund Request

If you believe you meet the eligibility criteria in Section 3a, please follow this process:

  • Step 1: Email info@theterranexus.com with subject line: “Refund Request — [Your Full Name] — [Enrollment Date]”

  • Step 2: Include your full name, account email address, enrollment date, selected plan, and proof of payment.

  • Step 3: Confirm in writing that no consumer inquiries were delivered to your account within 60 days of enrollment.

  • Step 4: Our team will review your request within 5 business days and may contact you for additional verification.

  • Step 5: Approved refunds will be processed via your original payment method within 14 business days of approval.

Refund requests submitted by phone will not be accepted. All requests must be submitted in writing via email to ensure proper documentation and compliance with our record-keeping obligations.

Dispute Resolution & Chargeback Policy

Terra Nexus is committed to resolving concerns fairly and directly. If you have a billing concern, we strongly encourage you to contact our support team before initiating a chargeback or dispute with your bank or payment provider.

By enrolling in Terra Nexus services, you acknowledge that:

  • Chargebacks filed for reasons outside the refund eligibility criteria in this policy constitute a breach of your service agreement with Terra Nexus.

  • In the event of a chargeback, Terra Nexus will provide your financial institution with full documentation — including signed agreements, inquiry delivery records, campaign activity logs, email correspondence, and A2P 10DLC-compliant SMS records — to support resolution in favor of Terra Nexus.

  • You agree to attempt to resolve any billing dispute with Terra Nexus directly before escalating to your card issuer or bank.

We want every partnership to be a positive experience. If something has not gone as expected, please contact us before disputing a charge. Our team is empowered to find fair solutions for our partners.

Policy Amendments

Terra Nexus reserves the right to update or modify this Refund Policy at any time to reflect changes in our services, business practices, or applicable legal and regulatory requirements — including updates to A2P 10DLC registration requirements and carrier messaging guidelines.

Material changes will be communicated to active agent partners via email at least 14 days prior to the effective date. Continued use of Terra Nexus services after any updated policy takes effect constitutes acceptance of the revised terms. The most current version is always available at theterranexus.com/refund-policy.
